Pour commencer l'année 2010, j'ai plaisir à signaler « A view from Paris » (AVFP), une newsletter électronique publiée par Jennifer Kirby et Denis Bensaude, deux noms bien connus de la place d'arbitrage de Paris, et au-delà.

Rédigée en anglais, elle paraît également sous forme d'une chronique trimestrielle au Mealey's International Arbitration Report.

AVFP est consacrée au droit français de l'arbitrage.Chaque numéro se concentre sur une décision phare et présente en outre sous la rubrique « See also », une dizaine d'autres décisions.

La décision phare fait l'objet d'une discussion détaillée sur trois ou quatre pages. Elle est accompagnée en annexe de sa traduction. A titre d'exemple, le numéro de décembre 2009 est consacré à l'affaire Encore Orthopedics c Liquidateur d'Akthea SAS dans laquelle les tribunaux français, et en dernier lieu la Cour de cassation, ont considéré que le tribunal de commerce était compétent pour statuer sur une action en soutien abusif engagée par le liquidateur d'une société contre un cocontractant nonobstant la clause d'arbitrage convenue entre ces deux parties.

Mise à part la qualité intrinsèque des analyses et des commentaires, et l'intérêt des décisions rapportées, AVFP se distingue par l'effort apporté à donner une présentation claire, objective et pédagogique du droit français. Pour autant, le lecteur ne sombre pas dans la torpeur qui parfois s'abat à la lecture d'un cours de droit. Son attention est tenue en éveil par un style dynamique et concret, tel qu'on en trouve dans les bons mémoires d'arbitrage.

Là où c'est nécessaire, les auteurs expliqueront de façon pratique un article du code de procédure civile ou un concept procédural, comme par exemple la tierce opposition ou l'exequatur. Mais surtout, les auteurs ont toujours le souci de faire comprendre à leurs lecteurs la forme des raisonnements et la démarche intellectuelle des juges français. Allant au fond des choses, ils en démontent tous les rouages pour en faire ressortir la logique, et les failles s'il y a lieu.

En un mot, AVFP est un bon outil pour appréhender tant le contenu que l'esprit du droit français de l'arbitrage.

As a starter for 2010, I have the pleasure of presenting “ A view from Paris” (AVFP), an elecronic newsletter published by Jennifer Kirby and Denis Bensaude, two names well known on the Paris arbitration scene and beyond.

AVFP, which is written in English, is also published as a quarterly commentary in Mealey's International arbitration report.

It is devoted to French arbitration law. Each issue will focus on a spotlight decision and will also contain a discussion of about ten other cases in the section “See also”.

The spotlight decision is reviewed in detail over three to four pages. Its translation is attached in an annex. For example, the December 2009 issue deals with the Encore Orthopedics c Liquidateur d'Akthea SAS matter in which the French courts, including the Cour de cassation in last resort, have considered that the Commercial court had jurisdiction over an action for abusive support filed by the liquidator of a company against a co-contractor, notwithstanding an arbitration clause contained in the agreement concluded between those two parties.

Leaving aside the intrinsic quality of its analysys and commentaries, and an interesting choice of decisions, AVFP should be given high marks for its clear, objective and educational presentation of French law. The reader however will not fall prey to the drowsiness which at times overcomes any one reading a legal textbook. His attention will be kept awake by a dynamic and concrete style such as can be found in good arbitration briefs.

Where necessary, the authors will explain in a practical way an article of the Code of civil procedure or a procedural concept, such as for instance “tierce opposition” or “exequatur”. But above all, the authors' constant purpose is to get the reader to capture the manner of reasoning and the intellectual approach followed by French courts. Going to the bottom of things, they will divide the courts' reasonings into their mechanical pieces to better show the overall logic of their decisions, or their failings as the case may be.

In summary, AVFP is a helpful tool for apprehending the substance as well as the spirit of French arbitration law.
